Mediation

Mediations are negotiations between two or more parties, with the assistance of a neutral facilitator, known as the mediator. The mediator does not offer legal advice to any party or say what is ‘right’ or ‘wrong’. Rather, a mediator is there to assist the parties to collaboratively reach a resolution.

A mediator is a neutral third party who will assist the parties to reach their own settlement. A mediator does not provide any decisions about ‘right’ or ‘wrong’ or tell what the parties what to do. An arbitrator is a neutral third party who makes a decision on behalf of the parties.

 

A mediator and an arbitrator do not offer legal advice to any party. Further, a mediator and an arbitrator do not provide legal counsel. Any party is encouraged to hire independent legal counsel, who can attend any scheduled mediation and/or mediation-arbitration if they wish to do so.

 

In  some situations, PMI Calgary will draft an agreement that the parties reach to save them time and expense in doing it themselves. PMI Calgary does not offer independent legal advice on any document drafted. Any party is encouraged to hire legal counsel to provide independent legal advice on any drafted agreement.
